Terms and Conditions for Festival Ticket Prize Draw
1. By entering this prize draw ('Draw'), you agree to be bound by these terms and conditions (the "Terms and Conditions"). Promotional materials relating to the Draw, including all information on how to enter the Draw, also form part of these Terms and Conditions. In the event of any conflict between any terms referred to in such promotion materials and these Terms and Conditions, these Terms and Conditions take precedence www.stpaulscarnival.net/termsandconditions
2. The promotor is St Pauls Carnival (Bristol) Community Interest Company (hereafter "SPC"), Registered company no. 10611881 with its registered office at Carnival Office, 29 Brigstocke Road, Bristol BS2 8UA.
3. Any funds raised through the Draw will support the work of SPC details of which can be found at www.stpaulscarnival.net or by via admin@stpaulscarnival.org.uk.
Eligibility
4. The Draw is open to residents of the United Kingdom aged 18 or over only who are not an employee or agent of SPC, Crowdfunder or any of its subsidiary or affiliated companies (an "Employee"), an immediate family member of member of the household of an Employee or otherwise be connected with operation or fulfilment of the Draw. The Guest must also be resident in the United Kingdom and aged 18 or over.
5. SPC reserves the right to require participants to prove that they are eligible to enter the Draw.
6. If a winner is found to be ineligible, SPC reserves the right to award the prize to another participant and to require the return of any prize already awarded. SPC shall not be responsible for entries that are made in violation of any applicable laws or regulations. Entrants from jurisdictions where the Draw is prohibited acknowledge that their entry may be considered void and are not eligible for any prizes. It is your responsibility to ensure that your participation is lawful, and SPC reserves the right to disqualify any entries deemed to be in violation of any laws or regulations, and will not be liable in any way if any entrant enters the Draw unlawfully.
7. Anyone entering the Draw accepts that in the event that they win a prize they are responsible for any and all expenses which they may incur which are incidental or connected to the prize including without limitation their own (and their Guest's) hotel, meals, spending money, travel to and from the event and other incidentals, including complying with any visa requirements. The winner is also personally responsible for any personal or incidental expenses and any VAT, national and/or local tax liabilities incurred in claiming or using the prize.
Entry Requirements and Entry Period
8. Entrants may enter the Prize draw either by purchasing tickets to the prize draw via the SPC Prize Draw page hosted by Crowdfunder UK or via free postal entry.
9. Paid entry to the Draw is available via Crowdfunder by clicking on the following link, completing the required fields and donating to SPCICC's Crowdfunder https://crowdfunder.co.uk/p/st-pauls-carnival-love-saves-the-day-prize-draw
10. For free entry, entrants may enter the Draw by mailing their full name, e-mail address and a contact telephone number (including area code if providing a landline number) to the following postal address; St Pauls Carnival Festival Ticket Prize Draw, 29 Brigstocke Road, BS2 8UA. Entries must be sent within an envelope. Entries received other than in an envelope will not be accepted. Maximum one entry per envelope. Personal and hand deliveries will not be accepted.
11. Entries submitted by any other means will not be accepted: only those submitted via an official method of entry.
12. The Draw opens at 12:00 noon (GMT) on Wednesday 15th May (‘Opening Date’) and closes at 12:00 noon (GMT) on Tuesday 22rd May (‘Closing Date’). Any entries received after the Closing Date will not be accepted.
The Draw and The Prize Winners
13. The draw of all valid entries will be carried out by an independent third party and will take place within 24hrs of the Closing Date and will be the first name chosen at random from all complete, eligible, properly submitted entries received before the end of the applicable Closing Date. The winners will be notified by email or telephone, and must accept the prize by Thursday 24th May. If a selected winner does not meet any or all of the entry conditions or refuses the offer or fails to accept the prize by Thursday 24th May, the Promoter may in its discretion select another entrant at random from the remaining eligible entries as soon as practicable as a replacement and to become a winner.
14. Multiple entries per person are permitted, but only one Prize per person will be given.
15. Entries from agents, third parties, syndicated entries or those made using methods such as a computer macro, script or the use of automated devices are not permitted in any way.
16. Unsuccessful entrants will not be contacted.
The Prize
17. The winner will receive two (2) general admission weekend entry tickets to Love Saves the Day 25th & 26thMay 2024 (the "Prize") with which they can redeem entry to Love Saves the Day 2024 for themselves and a guest (“Guest”).
18. The Prize is subject to the terms and conditions of Love Saves the Day which can be found at here.
19. The Prize is non-exchangeable, non-transferable and is not redeemable for cash or other prizes.
20. Tickets will be dispatched to the winner to the e-mail address provided on entry to the Draw on a date specified by SPC.
21. The winner and their Guest must arrive at the event together.
22. The approximate retail value of the Prize is £250.
General
23. SPC shall not be liable for any failure or delay in performing its obligations to the winner(s) if such delay or failure is caused by circumstances beyond its reasonable control, such as (but not limited to), cancellation of the festival, the acts or defaults of any supplier selected by SPC to provide the prize or otherwise that may cause the Draw to be disrupted or corrupted, or that may lead to loss or damage of the prize in transit to the winner.
24. Any participant who enters or attempts to enter the Draw in a manner, which in SPC's reasonable determination is contrary to these Terms and Conditions or by its nature is unjust to other entrants (including without limitation tampering with the operation of the Draw, cheating, hacking, deception or any other unfair practices, such as intending to annoy, abuse, threaten or harass any other entrants or SPC and/or any of its agents or representatives) may be rejected from the Draw at SPC's sole discretion. Furthermore, where such actions have significantly impaired the Draw, SPC may, at its sole discretion, add further stages to the Draw as it deems reasonably necessary in order to resolve any problems arising as a result of such actions.
25. SPC reserves the right to make any reasonable amendments to these Terms and Conditions at any stage. In this event, a notice may be posted on SPC's Crowdfunder page https://crowdfunder.co.uk/p/st-pauls-carnival-love-saves-the-day-prize-draw SPC also reserves the right to hold void, suspend, cancel, or amend the Draw where it becomes necessary to do so (including without limitation where any entrant(s) is/are found to be abusing or tampering with the operation of the Draw or entering using fraudulent means, or whom SPC believes to have acted in breach of these terms and conditions, or in respect of entrant(s) who do not give correct contact details or those who make an entry on someone else's behalf.
26. During the course of the Draw, SPC will collect and process participants' personal data (such as names, phone numbers, addresses, e-mail addresses). This information may be shared with SPC's agents and affiliates (including those outside the European Economic Area), such as where it is necessary in order to conduct the Draw including for the prize to be delivered to the winner. If participants do not provide any of the mandatory information requested when entering and taking part in the Draw, they may not take part in the Draw. Any personal information collected by SPC in connection with the Draw will be used in accordance with SPC’s Privacy Policy www.stpaulscarnival.net/privacypolicy
27. SPC must publish or make available information that indicates a prize has been awarded under the Draw. By entering the Draw, participants agree to have their first name and county featured in publicity materials relating to the Draw without further reference, payment or other compensation. Such information will also be provided to anyone who writes to St Pauls Carnival Prize Draw, 29 Brigstocke Road Bristol, BS2 8UA (enclosing a self-addressed envelope) within one (1) month after the Closing Date. If you object to any or all of your surname, county and winning entry being published or made available, please contact SPC at admin@stpaulscarnival.org.uk. In such circumstances, SPC must still provide the information and winning entries to the Advertising Standards Authority on request.
28. Save where it has been negligent, SPC does not accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant(s) entering the Draw, or as a result of accepting or using any prize. SPC is not responsible for any problems or technical malfunction of any telephone network or lines, online computer systems, servers, or providers, computer equipment or software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet or at any web site, or any combination of these, including any injury or damage to entrant(s) or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in the Draw. SPC is not responsible for any delays in delivery or receipt of postal entries.
29. SPC and their respective current and future parents, affiliates, subsidiaries, advertising and promotion agencies, licensees, successors and assigns and all of their respective officers, directors, agents and employees do not accept responsibility for entries that are lost, late, incomplete, inaccessible / blocked, corrupted, misdirected, delayed or damaged, regardless of cause, all of which are void.
30. SPC’s failure to enforce any provision of these Terms and Conditions in a given instance shall not constitute the waiver of such provisions.
31. Where the winner consents, their name, likeness and social media username may be posted on the social media profile of SPC after winner(s) has been selected, but there is no obligation for SPC to do so.
32. In the event of any dispute regarding these terms and conditions, conduct, results and all other matters relating to the Draw, the decision of SPC shall be final, and no correspondence or discussion shall be entered into.
33. Draw may be cancelled, modified, terminated or suspended in the event of any computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes outside the control of SPC which impairs or affects the administration, security, fairness, integrity, or proper conduct of the Draw. SPC reserves the right at its sole discretion to disqualify any entrant(s) who tamper(s) with any entry or has harassed any SPC representative or any other entrant(s) and to cancel, modify, terminate or suspend the SPC.
34. Entry to the Draw is conditional on acceptance of these terms and conditions, which are governed exclusively by the laws of England and Wales and under the exclusive jurisdiction of the English and Welsh courts. By entering this Draw you are deemed to have read and accepted these terms.
